The NCAA has another eligibility case on its hands.

Nyzier Fourqurean, who spent the past 2 seasons at Wisconsin, is seeking a court ruling to continue his college football career. Fourqurean is suing the NCAA over the 5-season eligibility window, arguing that 2 seasons he played at Division II program Grand Valley State should not apply.

Fourqurean originally sought a hardship waiver from the NCAA to allow him to play again in 2025. He joined the Grand Valley State ahead of the 2020 season, which was lost to the COVID-19 pandemic. Fourqurean says he lost valuable training time for the 2021 season after the passing of his father.

Similar to Vanderbilt QB Diego Pavia’s argument that JUCO seasons should not count against NCAA eligibility, Fourqurean makes an economic opportunity argument, saying his inability to get 4 seasons of NIL opportunities violates the Sherman Antitrust Act

“Said actions include, but are not limited to, preventing college student-athletes like plaintiff that attended Division II schools from competing in a third and fourth year of NCAA Division I football due to prior attendance at a Division II school, therefore limiting their economic opportunities to participate in the NIL marketplace available to Division I athletes, and otherwise unreasonably restrain competition in violation of Section 1 of the Sherman Act,” the lawsuit states.

Fourqurean seeks action from the court ahead of the Feb. 7 deadline to declare for the 2025 NFL Draft.
